Right to Free Education Act

The Right of Children to Free and Compulsory Education Act  or  Right to Education Act (RTE), which was passed by the  Ã‚  on 4 August 2009, describes the modalities of the importance of free and compulsory education for children between 6 and 14 in  Ã‚  under Article 21A of the  . India became one of 135 countries to make  Ã‚  of every child when the act came into force on 1 April 2010. History Present Act has its history in the drafting of the Indian constitution at the time of Independence[5]  but are more specifically to the Constitutional Amendment that included the Article 21A in the Indian constitution making Education a fundamental Right. This amendment, however, specified the need for a legislation to describe the mode of implementation of the same which necessitated the drafting of a separate Education Bill. A rough draft of the bill was composed in year 2005. It received much opposition due to its mandatory provision to provide 25% reservation for disadvantage d children in private schools. The sub-committee of the Central Advisory Board of Education which prepared the draft Bill held this provision as a significant prerequisite for creating a democratic and egalitarian society.Indian Law commission had initially proposed 50% reservation for disadvantaged students in private schools. []Passage The bill was approved by the  Ã‚  on 2 July 2009. passed the bill on 20 July 2009  and the  Ã‚  on 4 August 2009. It received Presidential assent and was notified as law on 26 August 2009  as The Children's Right to Free and Compulsory Education Act. The law came into effect in the whole of India except the state of Jammu and Kashmir from 1 April 2010, the first time in the history of India a law was brought into force by a speech by the Prime Minister. In his speech,  ,  Ã‚  stated that, â€Å"We are committed to ensuring that all children, irrespective of gender and social category, have access to education. An education that enables t hem to acquire the skills, knowledge, values and attitudes necessary to become responsible and active citizens of India. â€Å"[13] []Highlights The Act makes  Ã‚  of every child between the ages of 6 and 14 and specifies minimum norms in elementary schools. It requires all private schools to reserve 25% of seats to children from poor families (to be reimbursed by the state as part of the public-private partnership plan). It also prohibits all unrecognized schools from practice, and makes provisions for no donation or capitation fees and no interview of the child or parent for admission. The Act also provides that no child shall be held back, expelled, or required to pass a board examination until the completion of elementary education. There is also a provision for special training of school drop-outs to bring them up to par with students of the same age. The RTE act requires surveys that will monitor all neighbourhoods, identify children requiring education, and set up facilitie s for providing it.The  Ã‚  education specialist for India, Sam Carlson, has observed: The RTE Act is the first legislation in the world that puts the responsibility of ensuring enrollment, attendance and completion on the Government. It is the parents' responsibility to send the children to schools in the U. S. and other countries. The Right to Education of persons with disabilities until 18 years of age is laid down under a separate legislation- the Persons with Disabilities Act. A number of other provisions regarding improvement of school infrastructure, teacher-student ratio and faculty are made in the Act.The Act provides for a special organization, the  , an autonomous body set up in 2007,  to monitor the implementation of the act, together with Commissions to be set up by the states. []Implementation and funding Education in the  Ã‚  is a concurrent issue and both centre and states can legislate on the issue. The Act lays down specific responsibilities for the centre, state and local bodies for its implementation. The states have been clamouring that they lack financial capacity to deliver education of appropriate standard in all the schools needed for universal education. Thus it was clear that the central government (which collects most of the revenue) will be required to subsidize the states. A committee set up to study the funds requirement and funding initially estimated that  Ã‚  171,000  Ã‚  or 1. 71 trillion (38. 2 billion) across five years was required to implement the Act, and in April 2010 the central government agreed to sharing the funding for implementing the law in the ratio of 65 to 35 between the centre and the states, and a ratio of 90 to 10 for the north-eastern states. However, in mid 2010, this figure was upgraded to Rs. 31,000  , and the center agreed to raise its share to 68%. There is some confusion on this, with other media reports stating that the centre's share of the implementation expenses would now be 70%. At t hat rate, most states may not need to increase their education budgets substantially. A critical development in 2011 has been the decision taken in principle to extend the right to education till Class X (age 16)  Ã‚  and into the preschool age range. The CABE committee is in the process of looking into the implications of making these changes. Advisory Council on ImplementationThe Ministry of HRD set up a high-level, 14-member National Advisory Council (NAC) for implementation of the Act. The members include Kiran Karnik, former president of NASSCOM Krishna Kumar, former director of the NCERT Mrinal Miri, former vice-chancellor of North-East Hill University Yogendra Yadav – social scientist. India Sajit Krishnan kutty Secretary of The Educators Assisting Children's Hopes (TEACH)India. Annie Namala, an activist and head of Centre for Social Equity and Inclusion Aboobacker Ahmad, vice-president of Muslim Education Society, Kerala. [24] [edit]Status of ImplementationA report on the status of implementation of the Act was released by the Ministry of Human Resource Development on the one year anniversary of the Act. The report admits that 8. 1 million children in the age group six-14 remain out of school and there’s a shortage of 508,000 teachers country-wide. A shadow report by the RTE Forum representing the leading education networks in the country, however, challenging the findings pointing out that several key legal commitments are falling behind the schedule. [25] The Supreme Court of India has also intervened to demand implementation of the Act in the Northeast. 26] It has also provided the legal basis for ensuring pay parity between teachers in government and government aided schools [27] Haryana Government has assigned the duties and responsibilities to Block Elementary Education Officers–cum–Block Resource Coordinators (BEEOs-cum-BRCs) for effective implementation and continuous monitoring of implementation of Right to Educat ion Act in the State. [28] [edit]Precedents It has been pointed out that the RTE act is not new. Universal adult franchise in the act was opposed since most of the population was illiterate.Article 45 in the Constitution of India was set up as an act: The State shall endeavour to provide, within a period of ten years from the commencement of this Constitution, for free and compulsory education for all children until they complete the age of fourteen years. As that deadline was about to be passed many decades ago, the education minister at the time, M C Chagla, memorably said: Our Constitution fathers did not intend that we just set up hovels, put students there, give untrained teachers, give them bad textbooks, no playgrounds, and say, we have complied with Article 45 and primary education is expanding†¦They meant that real education should be given to our children between the ages of 6 and 14 – M. C. Chagla, 1964[29] In the 1990s, the World Bank funded a number of measu res to set up schools within easy reach of rural communities. This effort was consolidated in the Sarva Shiksha Abhiyan model in the 1990s. RTE takes the process further, and makes the enrollment of children in schools a state prerogative. [edit]CriticismThe act has been criticized for being hastily-drafted,[30] not consulting many groups active in education, not considering the quality of education, infringing on the rights of private and religious minority schools to administer their system, and for excluding children under six years of age. [31] Many of the ideas are seen as continuing the policies of Sarva Shiksha Abhiyan of the last decade, and the World Bank funded District Primary Education Programme DPEP of the '90s, both of which, while having set up a number of schools in rural areas, have been criticized for being ineffective[32] and corruption-ridden. 33] [edit]Quality of education The quality of education provided by the government system remains in question. [34] While it remains the largest provider of elementary education in the country forming 80% of all recognized schools, it suffers from shortages of teachers, infrastructural gaps and several habitations continue to lack schools altogether. There are also frequent allegations of government schools being riddled with absenteeism and mismanagement and appointments are based on political convenience. Despite the allure of free lunch-food in the government schools, many parents send their children to private schools.Average schoolteacher salaries in private rural schools in some States (about Rs. 4,000 per month) are considerably lower than that in government schools. [18] As a result, proponents of low cost private schools, critiqued government schools as being poor value for money. Children attending the private schools are seen to be at an advantage, thus discriminating against the weakest sections, who are forced to go to government schools. Furthermore, the system has been criticized as cat ering to the rural elites who are able to afford school fees in a country where large number of families live in absolute poverty. The act has been criticized as discriminatory for not addressing these issues. Well-known educationist Anil Sadagopal said of the hurriedly-drafted act: It is a fraud on our children. It gives neither free education nor compulsory education. In fact, it only legitimises the present multi-layered, inferior quality school education system where discrimination shall continue to prevail. [30] Entrepreneur Gurcharan Das noted that 54% of urban children attend private schools, and this rate is growing at 3% per year. â€Å"Even the poor children are abandoning the government schools. They are leaving because the teachers are not showing up. [30] However, other researchers have countered the argument by citing that the evidence for higher standards of quality in private schools often disappears when other factors (like family income, parental literacy- all corr elated to the parental ability to pay) are controlled for. [edit]Public-private partnership In order to address these quality issues, the Act has provisions for compensating private schools for admission of children under the 25% quota which has been compared to school vouchers, whereby parents may â€Å"send† their children in any school, private or public. This measure, along with the increase in PPP (Public Private Partnership) has been viewed by some organizations such as the All-India Forum for Right to Education (AIF-RTE), as the state abdicating its â€Å"constitutional obligation towards providing elementary education†. [32] [edit]Infringement on private schools The Society for Un-aided Private Schools, Rajasthan (in Writ Petition (Civil) No. 95 of 2010) and as many as 31 others[35] petitioned the Supreme Court of India claiming the act violates the constitutional right of private managements to run their institutions without governmental interference. 36]The pa rties claimed that providing 25 percent reservation for children from economically weak section in government and private unaided schools is unconstitutional. Forcing unaided schools to admit 25% students has also been criticized by saying that the government has partly transferred its constitutional obligation to provide free and compulsory elementary education to children on â€Å"non-state actors† like private schools while collecting a 2% cess on the total tax payable for primary education. 32] On 12 April 2012, a three judge bench of the Supreme Court delivered its judgement by a majority of 2-1. Chief Justice SH Kapadia and Justice Swatanter Kumar held that providing such reservation is not unconstitutional, but stated that the Act will not be applicable on unaided private minority schools and boarding schools. However, Justice KS Radhakrishnan dissented with the majority view and held that the Act can not apply to both minority and non minority private schools which do not receive any aid or grant from the government. 37][38][39] In September 2012, the Supreme Court subsequently declined a review petion of the Act. [40] [edit]Barrier for orphans The Act provides for admission of children without any certification. However, several states have continued pre-existing procedures insisting that children produce income and caste certificates, BPL cards and birth certificates. Orphan children are often unable to produce such documents, even though they are willing to do so. As a result, schools are not admitting them, as they require the documents as a condition to admission. [41]

Eth-125 Week 9 Final Prject

Individual Final Project: Kristopher Freitag Race and ethnicity and understanding its differences helped me achieve a certain amount of levity with the way I interact with others. America is extremely diverse, yet have an abundance of things in common. This is shown throughout history and right outside our doors, America, where our towns and cities are filled to the brim with personalities and of difference race and ethnicity share this culture that we call American society.I have learned to put a haul to being short sited and while I learned little about my own cultural history, the most important thing is to ensure you do not ignore it. Too many people have prejudged notions and are set in their own cultural history and views, but once one looks into it, there are vastly more things one has not realized and learned. It's hard to believe going in to the class that you would be so naive and ignorant to realize how close we are to one another, and how our struggles of differences have brought us closer together. For myself a Caucasian male, there is little to learn about my ethnicity, however as my wife is Hispanic we have grown closer as I have learned more from her and her â€Å"peeps† as she calls them, than most will ever realize. Learning about your own cultural can be beneficial, however I see more benefit in knowing another's, this in turn shows a level of respect for their own history and not a complete overlook of any walks of life they may have come from. The trends in immigration in the United States are very predictable and continue to grow exponentially.Immigration growth is expected to remain high within the United States, as people love this country of ours, and will continue to move here because of its values and most important of all, its freedom. Yes, America is not perfect, but it is considered the mother country and I don't think that reputation is going away soon. People must prepare for the continuing growth of immigration by integrat ing language, culture, and other small differences into our society. This is included in our schools, businesses, television, newspapers, and other outlets. For example, there should be language translations on bus stop signs or restaurant menus, etc. The high note of this exchange of culture will be the limited about of prejudice one can claim against â€Å"the white man† as in essence will become the minorities. Ironically, I see this as a good thing, America was founded on immigrants, I see an equal parts share the most compelling idea. Having the freedom to chose your own path and religion in the United States is why we are the fastest growing nation, it is time we embraced our differences and allow them to create a new life for us.The challenge the United States faces because of its diversity are ever changing and ever growing conflicts within its very own borders. We all want something to enhance lives, some better pay, some more freedom, legalization, marriage, the dive rsity of the things we fight for are vast in and of themselves. As we move forward we will have to begin to negotiate with all of these conflict and make a peaceful resolution available to the people and their demands, otherwise we will plunge ourselves back down into a civil war, of which I am not interested in.The ironic side of this, is if we as a society, as a country, as one can stand up and say this will happen and this is how it will be, than we might just unify our differences and permits the first generation of Americans to be born into a country where we work together, not against one another. The different cultural backgrounds integrated into one community, the different experiences we may learn from each other, the possibilities are endless, but if we compare our society to those of old, the expansion of war introduced new cultures and knowledge, why cannot we do the same without the ar.By simply being civil and tolerant and respectful to one another and treating each ot her as we would want to be treated. I think rudeness is at all time high. I am reading a book The Civility Solution ; it has much superior info. I think if we educate ourselves on this subject ; share what we are learning it will spread quickly. I was in a restaurant this evening ; my waitress was at the table next to mine ; I heard her use the word CRAP. I couldn't belief she said that, she did. What would make a person say that when she is talking to people about food. So raising consciousness is the way to go.I think experience is important & when people learn from experience it is the best teacher. Many who live far out away from others are moving in to the more populated areas & that will help. When you need help & the person who helps is not in the body or from the geographical area you love you start loving them anyway. Inevitably media stereotypes are often utilized in order to provide for a specific effect, especially in the entertainment, advertising, and news industries, which need a wide curtain to attract as large an audience as possible to quickly interpret information.Stereotypes protracted in the media can have negative side effect and become problematic. They can reduce the vast range of cultural differences in people to overly simplistic categorizations and transforming assumptions about particular groups into â€Å"realities† are engaged to justify the position of those in charge and perpetuate social prejudice and inequality The cultural groups being stereotyped are not given any opportunity to influence how they are represented. This is common within the media, regardless of style, show or channel, stereotypes and some causes of stereotypical portrayals, include a lack of diversity behind the scenes. However the basis for this creation of appreciation induced by the media is not without saying, the focus aimed at minorities of all ethnicities, families, and the appreciation for freedom, this lack of anger that can be pushed into our televisions, movies, and commercials is a method of uniting Americans and their differences.Only through an acknowledgment of our differences will the prejudicial learning's and educational services be made the misinformation to be openly discussed and approached with in a way which is likely to foster change. It is clear however, that if we can't talk about these differences and problems in their portrayal, we surely can't change it. Sigmund Freud, the famous Austrian physician changed the whole face of psychology in such a dramatic way by putting forward a theory of personality that stressed on the importance of the unconscious mind. The work he completed with patients suffering from mental disabilities like hysteria led him to theorize that our early childhood as well as our unconscious thoughts and actions contribute toward the development of our personalities and overall adult behavior. Changing an entire groups prejudiced attitudes, views and beliefs and an institution's racist actions is not simply fixed overnight.Reducing our racial prejudice as a society and racism is a complex task that changes in notions from community to community, so it doesn't offer a straight-forward approach, a step by step process that can be adopted and integrated without having a complete understanding of the environment and social context. This action would require knowing your community well and being able to choose a strategy that will best fit your own community's needs, history, context, energies, and resources, as a one size fits all will not work in this matter.

Operations and Supply Chain Management Essay Example | Topics and Well Written Essays - 1250 words

Operations and Supply Chain Management - Essay Example The report will asses some aspects of operations and supply chain management in terms of strategies to be adopted, supply chain design, supply chain planning, inventory and planning in retail and global operations, procurement management sustainable supply chain, demand forecasting, demand management, and product design supply chain. The paper will also asses some aspects of transport and distribution supply chain management, warehousing and material handling service operations, logistics outsourcing financial considerations, lean manufacturing human aspects of operations and supply chain management, quality management pedagogical issues, and maintenance research methodology in operations and supply chain management. It is worth noting that any of the above analysis will be done with an aim of developing a consultancy report to advice the management of the company about an appropriate â€Å"layout† for the proposed store. It is in this light that I will discuss the elements of a hypermarket layout plan in order to address all relevant considerations that should be put into practice to make easy the operations of such a business once in force. Introduction Studies have noted that the concept of operations and supply chain management has been emerging as a management issue of concern that organisations have sought to address to its conclusive end (Heiman and Nickerson, 2002, p.97; Singh and Power, 2009, p. 189). Horvath (2001, p. 205) observes that having come out as a dominant theme, supply chain integration is being considered to be of vital importance given the role it plays in business management. An organization's operations are strategically vital in the sense that, nearly all of the firms everyday activities are normally within the operations function. The relationship between a firm’s strategy and its operations is actually the big factor that determines the overall success of the firm in relation to its set objectives either in the short ru n or in the long run. Other scholars have been for the opinion that supply chain management (SCM) would be best carried out if traders come together and form and co-operate so as to achieve a common goal with an aim of acquiring benefits that may accrue from such integration. In order to determine the best layout and size of a new hypermarket near Sydney, I considered research studies on the Sydney market, consumer behaviors, the market’s potential in relation to local and international competition, international trade barriers, transport costs, local competition, government requirements, and political stability. In addition, I also researched on buyer behavior, competitive practices, distribution channels, media and demographic patterns through research studies about Australian markets, especially Sydney. However, the major discussion will be based on geographical expanse of Australia, especially Sydney, and demographic profile. This will put into consideration reliable data on potential demand, the cost of facilities, and operating costs such as labour and transportation Literature Review Australian Market Studies have indicated that operations and supply chain management (OSCM) assists companies to respond to market factors appropriately and allay any undesirable effect that may impede an organization (Holweg et al., 2005, p. 170; Chen et al., 2000, p. 436). In the sane way, other studies indicate that highly integrated supply chains help firms in building competitive advantages over rival companies (Myhr and Spekman, 2005, p. 180; Themistocleous et al., 2004, p. 393). From studies conducted on Australian internal market, (Chan, 2006, p. 238) has found

Diane Arbus, Photography of the Everyday or Pictures for the Freak Literature review

Diane Arbus, Photography of the Everyday or Pictures for the Freak Show - Literature review Example What is far more difficult to grasp from the work included in "The Dawn f Photography" is that the very frankness f photography can also inspire a whole other kind f artistic posturing. For if directness is photography's glory, it is also liable to be manipulated, used as a sort f all-purpose rhetorical device, until frankness itself becomes a form f obfuscation or artiness--which is a fair description, I think, f the work f Diane Arbus. Arbus, who committed suicide in 1971 at the age f forty-eight, is widely admired as a truth-teller, and if the initial reactions to the new book, Diane Arbus: Revelations, are any indication, the woman and her work are exerting as strong an attraction today as they did at the time f the posthumous retrospective at the Museum f Modern Art in 1972. Arbus's warts-and-all photographs, which are at once exposes and benedictions, create just the right kind f psychological havoc for a public that is all too willing to believe that any image that disturbs your equanimity is emotionally authentic, and that the greatest works fart are the ones that leave you wondering if you are yourself emotionally authentic. The public all too easily confuses hyperbole with honesty, and Arbus, who is intent on telling us how awful everything is, is a master f the highfalutin creep-out. In a series f photographs folder women on the streets f New York, Arbus seems to suggest that these ladies, who quite clearly take considerable pride in looking their best, are in fact ghouls; she gives such a sharp-eyed attention to their elaborately made-up faces and carefully arranged clothes that they begin to resemble the transvestites in whom Arbus also took an interest. The very eagerness with which Arbus's ladies out for an afternoon pose for the camera becomes a measure f their self-delusion. What's missing is the delicacy that Brassai (whose work Arbus admired) brought to his famous photograph f an old whore, swathed in cheap jewelry, seated in a caf. Brass reminds us that, for all her haggard theatricality, this wreck f a woman is still the proud possessor f a pair f beautiful, velvety eyes. Arbus uses the fixity f the image to deny people their freedom--and in so doing she also denies them their self-esteem. She undermines the young as well as the old, the pretty as well as the ugly. Often photographed front and center, in a dull symmetry, even her most sexually intriguing subjects seem wilted, marooned. Nobody ever looks their best, which is meant as some sort f revelation.

The Problem of Unwanted Births and the Awarding of Damages on a Public Essay

The Problem of Unwanted Births and the Awarding of Damages on a Public Policy Basis - Essay Example case a blessing.3 The circumstances posed to the Court of Appeal in Emeh required that it find some form of reconciliation between the two different stances of Udale and of Thake, though it was distinct from these two cases because the child had been born with disabilities. As a result, the damages awarded were restricted to those extra costs incurred as a result of the unwanted child’s disabilities, though the court claimed that it had awarded full costs. The approach as contained in Damages for the Birth of a Child4 suggests that Emeh was a result of the equation of unwanted pregnancy with consequential economic loss, and the damages were thus calculated according to â€Å"reasonably foreseeable financial loss directly caused by the unexpected pregnancy†.5 This approach was arguably taken too far in the decision of Benarr & Another v. Kettering Health Authority6in which it was held that damages could extend to private education of the unwanted child. ... the courts in relation to the decision of Emeh, and Ognall J in a subsequent similar case expressed his discomfort with a law that awards damages to the mother of a child, particularly if it is healthy; he said: â€Å"but there it is: that is the law†.8 Although the approach of the courts appears to be undecided on this matter, it is argued by some that awarding damages for both healthy and disabled unwanted children is perfectly acceptable according to principles of tort law,9 though decisions of the court have disagreed with this contention.10 There appears to be a major problem surrounding the distinction between unwanted healthy children and unwanted disabled children, and whether full or partial damages are to be awarded to both.11 It is suggested that the failure of the court in McFarlane to restrict its application to disabled children has caused an array of confusing exceptions to be created by subsequent cases on the topic.12 Yet what is the public policy behind the a pproach of the courts? It was claimed in Rees v Darlington Memorial Hospital NHS Trust13 that there are major public policy implications for making public bodies that are funded by the public to pay large sums of money to parents of healthy children.14 Such an approach has claimed that awarding damages for healthy unwanted children simply takes the law of tort â€Å"too far†.15 While this would seem to be a reasonably grounded policy which aims to establish the importance of causing healthy unwanted pregnancies and unhealthy unwanted pregnancies, highlighting the graver financial (and psychological) inconvenience of the latter, it has attracted much criticism.16 Such criticism is however warranted if one is to view the normal application of tort law which functions to award damages to healthy

Quality Issues in Qualitative Research Assignment

Quality Issues in Qualitative Research - Assignment Example Triangulation refers to use of more than two different methods in research as a means of confirmation of results (Miller, 2012). It aims at increasing the validity and reliability of data in research. With regard to this particular research, it is important for the researcher to use a variety of individuals in answering the research questions. Also, it is important to carry out sequel interviews and observations in order to verify the results of the initial study. Transferability relates to the ability of a piece of research to be applicable to other fields with similar characteristics to that of the researcher. It is advisable to ensure transferability by stating central assumptions as well as proper authoring the context of the project. (Miller, 2012) Fine Motor Skill Disability can be related to similar fields and the findings of the author can be used to determine if technology may or may not be used in said fields. Trustworthiness in research is all about credibility of all the information stated in the research project (Miller, 2012). This research involves the use of interviews and observation as means of data collection. These means are all first hand and cannot be verified by a third party therefore, it is the duty of the researcher to ensure that the interviews are carried out without bias, and are reported exactly as they occurred. The researcher must not doctor results in order to suit his own personal

Peter ducker Essay Example | Topics and Well Written Essays - 2500 words

Peter ducker - Essay Example Management can survive only through superior competence and continually improving performance. Drucker has emphasized the importance of role of management not only in business but also on political state of affairs of many countries. He asserted that only management can help most of the countries to come out of their economic and/or political struggle and build their economies. Drucker’s seven key elements, as described by Hutton and Holbeche, (Drucker, 2007a) that influenced organisational thinking and practice to a large extent include, scientific management as the key to productivity; decentralization as the basic principle of organisation; personnel management as the orderly way of fitting people into organisation structures; manager development to provide for needs of tomorrow; managerial accounting for use of analysis and information as the foundation for firm decision-making; marketing; and long-range planning (Drucker, 2007b). Drucker’s philosophy of management was based on five basic principles: setting objectives, organising, motivating and communicating, establishing measurements of performance, and developing people and self. Drucker refers to these principles as manager’s responsibilities. However, some of these principles have been criticized by others. For example, Parkinson argued that some of Drucker’s principles are vague and others are still to be defined. He also felt that Drucker’s ignorance of a specific issue/problem seems greater than his knowledge. Some of leading management theories of the 20th century contributed by Drucker include, management by objectives; putting the customer first; the role of chief executive in corporate strategy, and structure follows strategy. Drucker proposed the theory of the business, in which he contended the fact that businesses are run on a

Salvador Dali Essay Example for Free

Salvador Dali Essay Salvadore Felipe Jacinto Dali Y Domenech was born on May 11, 1904 . in Figueras, Spain. He was a Spanish Surrealist painter and printmaker by trade. Dali is commonly regarded as having been â€Å"artistically influential for his explorations of subconscious imagery†. As an art student in Madrid and in Barcelona, Dali assimilated a vast number of artistic styles and displayed unusual technical facility as a painter. It was not until the late 1920s however, that two events brought about the development of his mature artistic style. The first of these was Dalis discovery of Sigmund Freuds writings on the erotic significance of subconscious imagery and the second was Dalis affiliation with the Paris Surrealists, a group of artists and writers who sought to establish the greater reality of mans subconscious over his reason. To bring up images from the depths of his subconscious mind, Dali began to introduce hallucinatory states in himself by a process he described as paranoiac critical. In essence, the paranoiac critical meant looking at one thing and seeing another. In my opinion, this is an extended version of the face seen in the fire. Heads turn into a distant city, a landscape resolves itself as a still life, inexplicable combinations are seen to lurk magically beneath the skin of the world and thus the foundation for much Dalis artistic philosophy is established. Once Dali hit on this method, his painting style matured with extraordinary rapidity, and from 1927 to 1937 he produced those paintings which made him the worlds best known Surrealist artist. Dali depicted a dream world in which commonplace objects are â€Å"juxtaposed, deformed, or otherwise metamorphosed in a bizarre and irrational fashion†. Dali portrayed these objects in meticulous, almost painfully realistic detail and usually placed them within bleak, sunlit landscapes that were reminiscent of his Catalonian homeland. Much of my research indicates that the most famous of these enigmatic images is probably The Persistence of Memory (commonly known as Soft Watches) which was painted in 1931. In this painting, limp, melting watches rest in an eerily calm landscape. Moving to Paris around 1928, Dali frequented the Cafe Cyrano, the headquarters of the Parisian surrealists, and in 1929, he first exhibited his own surrealist paintings. Dali continued to study the writings of Sigmund Freud and subsequently declared an ambition to systemize confusion. In addition to such paintings as The Persistence of Memory, other famous works such as The Sacrament of the Last Supper which was painted in 1955 and is currently on display at the National Gallery in Washington, D.C., have become widely known as part of the definitive record of twentieth century art. In Dalis books, of which he wrote many himself, canvases, like The Persistence of Memory seem like looking down the wrong end of the telescope at a brilliant, clear, shrunken and poisoned world whose deep mannerist perspective and sharp patches of shadow invite the eye but not the body. I doubt whether one could imagine walking on that stretched, satiny beach among the oozing watches. This atmosphere of voyeurism lent force to Dalis obsessive imagery of impotence, of violence and of guilt. Even in his most extreme moments of anticlerical shock, however, research indicates that Dali remained a Spanish Catholic. He inherited from Spanish devotional art a paralyzing morbidity about flesh. He seemed to like anything that was not erect: running Camembert, soft watches, sagging loaves of flesh held up by crutches. Naturally all this was much more shocking fifty years ago than it is today: Dali was regularly denounced by Fascists and Stalinists alike as a decadent threat to youth. When he could no longer annoy either the bourgeoisie or the self- appointed guardians of the proletariat, he mortally offended the avant-garde by embracing Franco and the Pope, and was duly drummed out of the surrealist group for it Dalis reaction, natural in such an enfant terrible (approx. translation: terrible child), was to become more royalist than the King and more ostentatiously greedy than his Palm Beach and Hollywood patrons. If the net result was a tacky, phosphorescent caricature of Genius at Work, an embarrassment to most aficionados, it is still inconceivable to such eccentric art buffs that Dali the bad boy will ever be expelled from the pantheon of modern imagination. With the Spanish director, Luis Bunuel, Dali also made two surrealistic films. The first was, Un Chien Andalou ( French for An Andalusian dog) produced in 1928 and the latter was LAge Dor (The Golden Age) produced in 1930. Both of these films are commonly described as being grotesque but filled with highl y suggestive images. The production of Dalis art and films was both complimented and further popularized by his maintenance of in image similar to the one reflected in his works;: His eccentric appearance consisting ordinarily of a flowing cape, handlebar mustache, and popping eyes helped to make Salvadore Dali recognized worldwide. In the late 1930s, Dali switched to painting in a more academic style under the influence of the Renaissance painter Raphael, and as a consequence, that was another example of why he was expelled from the Surrealist movement. In the later years of his life, Dali spent the majority of his time designing theater sets, interiors of fashionable shops, and jewelry as well as exhibiting his genius for flamboyant self-promotional stunts in the United States, where he lived from 1940 to 1955. In the period from 1950 to 1970, Dali painted many works with religious themes, though he continued to explore erotic subjects, to represent childhood memories, and to use themes centering on his wife, Gala. Notwithstanding their technical accomplishments, these later paintings are apparently not as highly regarded as the artists earlier works. Salvadore Dali died on January 3, 1989 in Figueras and is now often regarded as one the greatest twentieth century artists yet. With some artists, death is only a ratification of decay: it releases them from the humiliations of their late careers. So it was with Salvador Dali, who when he died at the age of 84 was perhaps the archetype of that 20th century phenomenon, the embarrassing Genius. He was the first modern artist to exploit fully the mechanism of publicity. He appropriated the idea of the artist as demonic obsessive. He dealt with the question Why should your fantasies matter?. Clearly, Salvadore Dali utilized communication and all forms of contemporary imagery to make not only his works, but himself into a legend. Graduate Employment Opportunities in China

Graduate Employment Opportunities in China The purpose of this paper is to the moving from education into the China employment market. The objectives to write this essay is desire know the graduate market in China accurately and try to understand the actual situation. In this paper, we shall first briefly introduction to the marketplace for graduate employment opportunities in China. What do employers look for is the essay going to describe secondly. Thirdly, a general comment on the intended career path and target position after graduation. In addition, the writer will through the conclusion to state briefly what skills are vital to cope with target position after graduation. (Done, J. Mulver, R, 2011) stated the term labour market is used to describe the interactions between employers who need workers and employers. labour market is both complex and dynamic, that there have two fundamental forces driving the labour market, which are demand and supply. So the relationship between supply and demand is critical. In the graduate labour market, the people who are seeking a job is the supply, and the employer offering the job is the demand. The supply have to make they known in the marketplace, and the demand have to let people know they have a job and they want to fill. This essay will focus in the manufacturing industry which is essential industry in China. The Marketplace For Graduate Employment Opportunities At Home Country Under the comprehensive influence of economy, politics and society, the employment of graduate is confronted with a fierce situation in China. In the meanwhile, it also presents both unprecedented opportunities and challenges for current graduate employment. In the past thirty years, Chinas economy has grown at an average of approximately 10% a year, and become the worlds second largest economy now. Chinas markets have opened to the whole world and the trade has increased remarkably. And China is the largest global producer of washing machines, cameras and computers (among hundreds of other products), its manufacturing capability is very eminence. In order to face foreign and domestic huge market, many companies are constantly expanding staff recruitment. Chinas human market network stated that the percentage of the bachelor of business administration employed in manufacturing sector was 58.8% in 2010. The business administration possess wide range of knowledge, including planning, organization, direction, control and organize the relevant business operations and behavioral decision. As a result, the ratio was higher than other major in manufacturing. In addition, (Done, J. and Mulvey, R. 2011) stated the graduates have more workforce and seem to be bring innovation and creativity to the company. This is the reason why many companies like to hire the student who just finished university. The marketplace for graduate employment opportunities in China is massive. Considering that is labor demand in Chinas manufacturing industry is large. The Ministry of Social Security and Human Resources described employment as stable and normal with a record about 6.94 million jobs created in the 2012 first half. On the other hand, The challenge for graduates is still exist. The speed of society development is slower than the speed of the increase of graduated students; as a result, some graduates cannot find positions in the job market . At the same time, expectations of college students in getting good jobs in big cities causes the drastic competition in the metropolis job markets. On the contrary, in the vast countryside and small or medium cities, there are still many vacant positions that students dont want to accept. Example like GuangZhou, it is a big city in Guangdong province in China. But the graduate employment opportunities is seldom in this city, because the manufacturin g industry is not important in GuangZhou and a large number of the graduate are looking for a job here, this is a competitive job market. But the cities beside the GuangZhou, like DongGuan, HuiZhou, three of them are Medium-sized city. There are so many employment opportunities over there. The first reason is the medium-sized city always pay attention to manufacturing industry, the secondly is most graduates dont want to accept work in the medium-sized or small city, there are still many vacant positions. A lot of the graduates tend to overestimate themselves and their expectations to the future jobs are too high. Almost all of them have a high requirement of their salaries and working conditions, they would rather stay in big cities waiting for job opportunities than go back to their hometowns and find other jobs. This is the important reason why marketplace for graduate employment opportunities in China is massive, but many of graduates cannot find suitable job in big city. In this section, combined with the date form government department, journal, and the industry news, the graduate student employment opportunity of manufacturing industry in China is very well in small or medium city. Small and medium city hope the graduates work there. There are many graduate jobs available in manufacturing industry and the labor demand in China is large. In the big city, the students can not be optimistic about employment prospects, the labour market competition is intense and almost full. Since everyones power is limited, we cannot change the social environment within a short period. However, we can adapt ourselves to this society. Above all, we should change our obsolete employment concepts and adjust the psychology in employment in order to set up a proper conception of job-selecting views. Try to adjust the employment exception according to own ability. Do not think too much expectation on the salary and working conditions when we seek for jobs we have never don e before. Hold a right attitude towards jobs and set job expectation at a suitable level is the key to the solution and remission of the difficulty in employment. Besides, the graduates should strengthen the sense of competition, never complain about the society. To sum up, we have to learn how to assuage and solve the employment problem by ourselves, what we should do is to take it rationally and combine our own situations with facts. What skills and competencies are graduate employers looking for? All graduates need good employability skill. When the graduate is taking job interview, the employers will pay much attention about the employability skills. So, which skill is most important in employability skills? Following that, the table shows the 24 skills which were most deemed important based on survey by employers. Where 1 is the least important and 5 is the most important. Table 1: Table showing importance (least important to most important) of graduate skills (J.M. Norusis,2004) Form this table, the most important seem to be teamwork, the following is motivation, learning attitude, independent work, communication skill, inter personal skill, flexibility etc. After that, the academic learning is the least important in 24 skills. In the labour market, a lot of competitors have the same degree as you or higher than your degree. Therefore, the graduates have good employability skill is a major key to get the job. As a student, In addition to get the graduate certificate, still have to import the employability skill. This will be measured and tested throughout the recruitment and selection process. What Do Employers Look For? In the manufacturing industry, the employers are looking for graduates who are enthusiasm, positive mental attitude, efficient, detail oriented, honesty, listening and Prioritize. Also, graduates who have good teamwork, motivation, learning attitude, independent work, communication skill, inter personal skill. The prioritize and skill of communication are most important in manufacturing industry, by reason of there are one important step in factory when it is manufacturing products. The step is assign work mission. Excellent assign work mission can help the factory improve work efficiency to make best profit. As the result, the prioritize main is good at assign work mission, and the communication skill can help others understand what you talking about and listening to your order. Nowadays, all the companies are using the computer to do the work, so, the internet technology is become more and more important. The graduates should have basic knowledge about the computer. Next, most employers also look for at least a 2:1 in a degree, international experience and foreign language skill. Chinas markets have opened to the whole world, employer intend to staff has international experience and one or two foreign language skill to help the company into foreign markets. Intended Career Path My intense interest now is international business management ,a subject that combines global issue, international trade, business management and social value. But, when I already have jobs, I have to understand salary expectations before graduation are generally lower than the real payment. I hope after two years, I can understand the manufacturing industry market, supply chain, and get much experience of management. This is the objective of short term plan. Medium term, 4 to 7 years: In the medium term plan, to find a suitable development of the company, set the mentality is my objective. Five of these occupations are different types and following my skills, motivations, desires. From this result, I think the Environmental consultant, Equality and diversity officer, Investment analyst and Management consultant are right for me according my hobby or skills. First, the environmental consultant and investment analyst, can give me much personal autonomy and high profit, but it is not following my knowledge of my degree course. After that, the equality and diversity officer, management consultant are according my degree choice. The important condition of these two occupations is problem solving. I believe I am good at these occupations cause I was study in two different countries to learned many skills. One is Singapore and the other is China. In this two different countries, I had join many school group work, and I was working in a big company about three months in China. (see Appendix 18) I have a lot of opportunity to learn how to solving problem. Also my intense interest now is business management. The result form my Abstract Reasoning Skills Feedback Report, my score was at the 65th percentile. The report is testing the ability of the new idea and problem-solving. Conclusion In conclusion, the employment opportunities sound positive in China. The labour market in big city intense and almost full, but the small and medium city still many vacant positions. The graduates have to change their employment concepts. They can not tend to overestimate themselves and their expectations to the future jobs are too high. Graduates should understand their salary is not high when they just finished university to start a job. But the first or second year in your job is a good opportunity to improve the skills and get experience. As we know, the Teamwork, motivation, and learning attitude were most deemed important based on survey by employers. The graduates have to remember improve their skills everyday. Good skills is a good key to get the job in a fiercely competitive occupation labour market. Set career goals, is the core of career planning. The cause of the success or failure of a person, to a large extent depend on the availability of appropriate target correctly. No goal, as the boat into the sea, vast surrounding, there is no direction, I do not know their own going. Goal setting, following a career in the choice of route choice career after aim in life to make choices. Next step From the result, I understand I have to improve my teamwork skill now. Before that, I like to work alone, but I know the teamwork is more important than work alone now. From the table, we know the most important is teamwork. The employer always looking for who have good teamwork skill. If I do not improve this skill, I will be lost many opportunity. To improve my teamwork skill. I should join more group activity, communicate with others and try to give more opinions to the team. On the other hand, I will continue to find the internship in my summer holiday. I have send letter to Kaisa Group Real Large Estate Company, I hope I can work in this company in summer holiday again. Because the internship is looking for student to do a sales management, that is very precious experience for me, cause that my target position is sales management. In the future, I hope I will become a prominent businessman in this field someday.

The Importance of Uniforms in Public Schools Essay -- Argumentative Pe

The Importance of Uniforms in Public Schools Abstract: For a while, dress codes have been implemented in private and parochial schools across the county. It wasn't until more recent that the issue was brought to discussion about a dress code in public schools. Uniforms serve a purpose to the schools that are adapting the change in attire. The uniform dress code has helped make private and parochial schools more prestigious for their organization and the results of it. Uniforms would be beneficial to the public school system because a lot of what the public school system is known for would be stopped because of the newly executed dress code. The Importance of Uniforms in Public Schools Imagine a world where there was no organization, and it can be related to a public school. Imagine a world with no violence and gangs and class separation, and you can relate it to a parochial or private school. This is quite possibly due to the fact that the private and parochial schools use uniforms. Public schools have recently stepped up to their 'A' game around the country by implementing a new dress code. This dress code involves the required clothing in uniforms, which for a boy may include, a blazer, a polo shirt, a tie, khaki pants and dress shoes; and for a girl, a polo shirt with a plaid skirt, white socks and dress black shoes. This type of attire in school puts students in the mindset for future life, while making them feel as if they are accomplishing a great deal. While uniforms were first used in England as a source to ostracize poor children who could not afford attire, their purpose has changed drastically over the past century to represent the complete opposite the n their origination. Securing The Electronic Operating Environment Essay -- Information Tec

Purpose Operating systems, applications, databases, and other types of information processing systems are the core element for all business operations all through the private and public sector environments. Because no information system is bulletproof, nor is there any way to ensure complete safety while using any type of electronic device it is essential to practice vigilance at all times. Viruses, Trojans, worms, and other malicious tools are used daily by hackers at an attempt to compromise sensitive data and integrity of information systems. Without stable, secure applications and operating systems that have been updated with the latest patches, and tested for durability to provide a secure computing environment, the confidentiality, integrity, and availability to the entire domain and infrastructure are at risk. Differentiating between the good and bad is crucial to the protection of IT assets and personnel. This report will evaluate operating system and application security, methods us ed to verify authenticity, and reveal the most common vulnerabilities found throughout various digital operating environments. Digital information security can be defined best as the protection of IT assets and services against unauthorized access. An authorized user or service with legitimate permission to access sensitive data systems or applications may engage in malicious activities such as inputting incorrect data into the system to force others to repeat the same task over. Although these types of activities may not cause immediate irreversible damage to the infrastructure it still remains important to prevent such incidents from occurring before they escalate into something more serious. Freedom of Choice (oedipus the King) :: essays research papers fc

People have visited physics’ and fortunetellers for centuries to find out what is going to happen in their future, or to help them make an important decision that they faced. This is what King Laius did in the play â€Å"Oedipus the King† by Sophocles. King Laius, Oedipus’s father went to the Oracle at Delphi. Upon receiving the prophecy that his son Oedipus will kill him and marry his mother and commit incest with her, King Laius of his own free will ordered that Oedipus feet be bound by riveting his ankles together and sent him to Mount Cithaeron to perish. â€Å"Laius, king of Thebes, was warned by an oracle that his son would slay him. Accordingly, when his wife, Jocasta bore a son, he exposed the baby on Mt. Cithaeron, first pinning his ankles together (hence the name Oedipus, meaning Swell-Foot)†(1). King Laius exercised his free will when he chose to believe that the prophecy would come true. Had he chosen to disregard the prophecy, then Oedipus would have known who his parents were and would not have murdered King Laius or married Jocasta. If mans future is predestined then it would not matter, but if mans fate lay in his own hands and is determined by the decisions he makes, he would be able to use the prophecies to make better decisions. â€Å"Individuals can respond to a proposition or any encountered fact by instantly thinking of its opposite. Every thesis can produce an antithesis; different logical meanings and patterns can then be discerned. This rational ability of the mind to take alternative perspectives means that an individual can then choose or create a new synthesis from different perspectives†(2). It’s not that he chose to take action to action to prevent such a dastardly act, but the way he chose to deal with the situation that set the stage for it to happen. It could be said that Sophocles was trying to demonstrate that if you choose to believe in predestination, you subconsciously deny yourself the ability of free will. â€Å"Finally, perhaps faith can be seen as a form of fixing our attention upon God and thereby freely committing ourselves. The theologian Nicholas Lash says that the first words of the Creed, "I believe in God," do not express one's considered opinion about God's existence but affirm that all of my life is "set henceforward steadfastly on God, and God alone.

Procurement Essay

1. A buyer who communicates expectations clearly. The number one quality of a good customer is that they are able to express what they want and need. This ability is vital for a supplier to deliver the right product or service. A supplier can’t deliver what wasn’t asked for. As with pretty much every project of any sort that involves more than one person communication is the biggest factor in success. Poor communication will without a doubt cripple your project and it most often comes in one of two different forms. First there is slow communication. When clients take weeks to get back to you on simple updates projects drag and you don’t get paid. Additionally your motivation for the project will probably drop significantly causing you to take shortcuts when you finally do hear back on changes or approval or make assumptions when you don’t hear back. While your mindset may be that you just want to get this project out the door it could result in sub par work and a poor reflection of your capabilities. Second there is miscommunication. While your client may get back to you in a timely manner there is just something off between the two parties. This road can go both ways, as a designer working with clients its up to you to find out what their comfort level may be when communicating ‘techy’ things. Some clients are plenty familiar with the technology and best practices that go into web design while others will need to be walked through the process more. The positive side of this problem is that it is very avoidable. Communication issues are often glaringly obvious before a project ever gets under way. If you are looking for a project and not a headache you will likely be better off passing on projects that appear to be ridden with communication issues from the get go. 2. Allows a reasonable amount of time for the work. The business world is filled with customers who want it â€Å"yesterday.† Often, what these customers actually get is a rushed job full of mistakes and needing a lot of rework. A good customer, however, understands that quality service from the supplier takes time and plans accordingly. 3. Available for questions. While most suppliers can and do work independently, there’s nothing more frustrating for a supplier than being surprised by an obstacle and being unable to reach the customer for questions and clarifications. Smart customers therefore know that it’s cheaper to get it right the first time than to fix it later. They make themselves available. 4. Pays a fair amount for work required. A bargain is a bargain, except when it’s not. Often paying less than market rate for work results in getting work of less than average quality. That’s because a supplier who works on the cheap often must take on more work than they can really do well just to make ends meet. 5. Pays in a timely fashion. This is a buyer who discusses their payment terms with the supplier before the project begins and then honor those terms. If you say that you will pay within x days of the project’s completion, be sure to pay that amount within that timeframe. Don’t make the supplier beg you for their payment. You could ruin your professional reputation and even your credit history. 6. Has high integrity. Honesty is at the core of every successful business relationship. Suppliers like to deal with customers who conduct all of their business in an honest and transparent fashion. Not only is this a great way to conduct oneself in general, it will also enhance the buyer’s business reputation. 7. A buyer who allows the supplier to do their job. Once the buyer has hired the right person, then they the supplier possess the talent and skill to do the job well. The buyer therefore keeps an open mind about what their supplier proposes. They don’t be constantly second-guessing their supplier’s abilities. 8. A buyer who seeks an ongoing relationship. The best customers understand the value of an ongoing relationship. They don’t want to have to â€Å"break-in† a new supplier with each new project that they have. This will encourage loyalty from both parties which is very essential in any business undertaking. 9. A buyer who gives credit where credit is due. While it’s not always possible to give a supplier authorship credit for a product or service, a discerning customer notices when a supplier puts in extra effort or goes the extra mile in a project. 10. Committed to quality. Most suppliers take pride in their work and want to produce high quality work. They dislike it when a customer asks them to take shortcuts. 11. Project Attachment: Look for clients who are attached to the project at hand. If a project has a high personal or financial value to a client it can help solve a lot of the problems on this list. Working for a client who doesn’t care about the project at hand can be a demoralizing experience. While it might be counter-intuitive try to avoid clients that ‘need’ to have a project done. 12. Additional Work: It’s a little bit of a bonus but also one of the best characteristics about any client. A client that refers their friends to you or has multiple projects to tackle is a huge value to any designer. Be sure to reward your loyal customers with discounts and your best work. After all these clients are saving you a huge amount of time and the effort of finding additional work, time that would otherwise go unpaid. If you like a client that you work with and had a project that went well don’t hesitate to ask them for a testimonial and suggest that they share your contact information with anyone they know who needs a web site as well. 13. Save a large deposit (or buy with cash!) A large deposit shows a level of commitment to the property, as that money is non-refundable when you exchange contracts. The only thing that trumps a massive deposit is, of course, a cash buyer. Assuming the buyer has the funds in place and can prove it, the sale is much more likely to go through quickly without business owners being involved. 14. Flexible buyer: Sellers absolutely love flexible buyers because it means they can do things in the way they want, at the pace they want. This is one reason they like chain-free buyers because they tend to be able to move very quickly if necessary. But the opposite is also true. Perhaps your seller has been unable to find a suitable property themselves so they may want to agree a price with a buyer who is prepared to wait for them. If you are happy to proceed quickly, or slowly, and you make this clear to the seller, it could work in your favor.

Racial Discrimination in US Employment

The United States has been long considered as a nation defined by diversity. An article from the website Mesriani Law Group mentioned that this country is a point where in culture and faces meet. It is the union of languages into one word, and images of many people into one name. However, it cannot be helped that cultures would clash, and the array of disagreements could be far and wide. It cannot be helped that some minds could remain closed even after all the decades different people co-existed. There remains biases and stereotypes, which label so many people with negative names.Although there has been actions and campaigns to counter this unjust behavior in society, it cannot be helped that the ideal one nation is still under construction. Racial discrimination is also most evident in the workplace, where the battle for the better color continues. It could be the pressure from the norms constructed then construed by society. It could be the tradition they never outgrew. It could b e the close-mindedness of people developed by years of inclusion from the many realities of life.Whatever caused this unjust treatment in the workplace, it persists to be a problem in an individuals professional life. This paper aimed to give light to the basic laws that protect the employees from the different forms of discrimination in the workplace. Finding the basic information one should know about this unjust activities is essential in finding conclusions regarding the matter. Furthermore, this paper aims to relate cases into the deliberation to have a firmer grasp about the issue at hand. This is to re-establish the reality of this issue in the country.Discussion Title VII of the Civil Rights Act of 1964 With the rise in statistics regarding racial discrimination in the country, laws were also raised and deliberated upon to protect those who experience this kind of injustice. According to the US Equal Employment Opportunity Commission, there is a law that aimed to protect the individuals who are discriminated against due to their race and place of origin, as well as their sexual orientation and religion. The law also aimed to protect those who are discriminated due to the color of their hair and eyes. This category also includes individuals who are in anyway associated with any particular culture that is different from the host country. This law is the Title VII of the Civil Rights Act of 1964. Employment cannot be denied of any person due to the color of their skins. This law also mentioned that it is applicable to any organization. The local and state government organizations are not exempted from this law and should abide by it. Under this law, it is also prohibited to make organizational decisions based on the stereotypes and general assumptions of different cultures. They cannot point specifically the different races, even those multi-racial individuals, when regarding the total functioning of the organization. In this light, it is considered unlawfu l to evaluate an individual for recruitment, hiring promotion and termination based on the color of their skin. Their wages and other privileges in their employment should not be affected by this factor as well. Organizations should be very particular that they do not have policies that may spite or render a culture discriminated against. Instead, they should be able to adapt a one culture that discourages racial slurs and prejudices.Kinds of Racial Discrimination in the Workplace According to the aforementioned website Mesriani, there are two kinds of situations wherein racial discrimination occurs. This needs to be re-established so find certain solutions to remedy the predicament. The first kind of racial discrimination is the Disparate Treatment. This is the basic form of racial discrimination where the individual is judged by his or her ethnic background and other similar characteristics that may bring about a similar impact on the individual. The second kind is called Disparat e Impact. This, on the other hand, is discrimination brought about by the policies rendered by management, which had a negative effect on an individual based on the color of his or her skin. Website Making Sense also mentioned these kinds of racial discrimination. But they called these as Direct and Indirect discrimination respectively. Those Who Need Protection These people who are being discriminated against need all the protection they could get. They are the people of color, and there exists a certain spite in between. As much as anyone would need, an individual needs to make a living to survive this fast paced society. If they would be discriminated against in employment, then these individuals are only offered the kind of jobs that were stereotyped to fit them. They will not be able to grow, not have any professional advancement, regardless of their capabilities and educational attainment. Furthermore, a lot of individuals of color have superior knowledge and skills. But because of discrimination, they cannot surpass judgmental eyes and their own aspirations. They are unable to make a career and a life because certain people think that they are not capable of doing anything except for menial and routine jobs.Should not one look far beyond, and go deeper than the color of one's skin? Those Who are Liable On the other hand, who are liable for this kind of unjust treatment in the workplace? Website the New Black Magazine wrote that those who ultimately are liable in such situations are the employers. They are in charge and are responsible for the welfare of every employee, regardless of race and certain physical features of an individual. When an employee is involved in the case of discrimination, both he and the employers are taken during the deliberation. It is a rare case though, as the magazine mentioned, for the employer to win against a case of racial discrimination in their office. In the cases when they do, the case continues against the employee invol ved. Race Relations Act of 1976 Simultaneously, there is another act that aims to protect different races. This is called the Race Relations Act of 1976. This, on the other hand, also aims to protect individuals not only in employment but also in housing, education, and the availing of other products and services. On top of daunting discrimination, as the earlier law entailed, this law is aimed to encourage race equality. It takes the issue of equal rights across cultures to a higher level. A Council under this Act is conjured for three reasons. They should eradicate discrimination against different racial groups, promote opportunities across the culture, as well as to reinforce the importance of having good relations between racial groups. Growing Statistics Despite the Improvements According to USA Today, there is a 24% increase in the number of cases about racial discrimination in the workplace. This was reported by the Equal Employment Opportunity Commission. There are 6, 977 case s reported in the year 2007, in comparison to the 5, 646 of the previous year. The article also mentioned that the number of reported unjust activities to the commission was raised to more than half since the year 1991. It was also written that the Commission is yet to study the sudden rise in numbers. However, their speculations are that the spike began with the case about six black teenagers and their white classmate. This injustice also stretched to the offices no one would have found unethical in this sense. On the other hand, an article from the New York Times also mentioned that there is an obvious increase in the number of racial discrimination cases in the workplace. Author Linda Greenhouse mentioned that the Supreme Court has been rather active regarding this kind of cases. One of the cases newly reported then is concerned about the protection of one employee who retaliated against a discriminating supervisor. The other was based on age. Although Title VII also included prot ection individuals against retaliation, the article mentioned that certain courts do not take this as serious as they should. Moreover, this kind of protection was only given to those employees who instigated the complaint against their employers, or those who formally approached the Equal Employment Opportunity Commission. In this regard, an article from the website Human Rights Watch implied that despite the growing number of cases about racial discrimination in the US workplace, those in government still failed to find an answer to completely annihilate the problem. They have been battling with the issue for so many years, and yet the statistics continue to rise. They have signed and implemented many of these laws, but there are more unhappy employees. The laws they created looked very promising. Actually, it promised a lot of things. It promised protection and be on equal footing in regards to employment. Yet the stereotypes remain to be eradicated. The color of the individual's s kin is assumed to be tied with a certain kind of job, despite the achievement and credibility he or she carries. The above mentioned article said that there was little progress, even during the time of Clinton. The public officials each have an obligation to the advancement regarding the human rights of each individual in their country. Yet many did not fulfill them, or chose to ignore the rising issue. The article mentioned that thousand of workers are discriminated against, harassed and threatened each year because these individuals persisted that they practice their rights to employment. Moreover, in certain states, there were campaigns against migrant workers. The research studies done my many organizations about the issue should be a signal loud enough for the politicians to move. Unfortunately, little effort was made on their part. Small Scale Beginning With this problem, the solution should start at a small scale. That is for the individual to have the initiative to make that change.By beginning from where the case occurred, the government might be further called that the people are doing something about it, and that they need the full support of the people the citizens voted into those positions. The victim should first know his or her rights as an employee. He should be educated about the laws by the government and the policies and regulations of the company regarding their welfare in the workplace. Being educated is their biggest defense. With this knowledge, they would know when employers are being discriminatory of their employment. They could be discriminated against for many reasons. However, it is racial discrimination in the workplace that is most prominent in the a diverse country such as the United States. Backed with this basic tool, an individual will be able to recognize when an employer or co-employee is being discriminative of his person as a man of color. When this situation rise, he or she should immediately report this to the authoritie s. In the recent years, authorities have been more strict about these situations, and protection can definitely be attained. In this light, there remains the question why, despite the laws for protection, these kinds of problems continue to rise. They have become more strict, yet there were no significant changes. Responsibility of the Employer On the other hand, the employers should also do something about this kind of injustice in the organizations they own or manage. The Race Relations Act gave suggestions to what employers should do especially when they are held liable to every name listed in their payrolls. According to the act, the employer should take charge in monitoring their staff, including the applicants for hiring and candidates for promotion and further training. On top of this, they should be able to monitor the grievances by these employees. It should be well documented. No matter how minimal the complaint is, they should always give just attention to it. In line with this, they should also monitor the cases wherein disciplinary actions were implemented. This is also to see if their part as an employer is doing what they can in their level. They should also be able to monitor the outcomes of performance assessment of the employees. While they are taking care of the welfare of each employee, they should still be able to keep the performance of the employees in line with the objectives of the company. This is to keep the employee's end of the bargain intact and active. As the nature of business is, it is a give and take relationship. It is also important for the employers to monitor the type of training they have for their employees, and who are taking these trainings. Training has a huge effect on the kind of work life existing in the workplace. If their training have any effect on the behavior of their employees, then there are also effects on the output of each employee. Lastly, the Race Relations Act also suggests that employers should take note of the people who were dismissed or have resigned from the organization. The statistics from these numbers could lead to how the organization should change, if necessary, or if there are some improvements that could utilize for both their benefit as well as that of the employees. Conclusion Racial discrimination in the US work environment is a reality one will eventually have to face. When one thought that this kind of prejudice only happens in the the community, it also stretch in the offices both small and broad across the country. Many are affected as there are a wide array of cultures that clash against each other. It cannot be helped that there are cultures that will ultimately contradict the next. However, when dealing with professionalism, these biases and prejudices should be put aside for the progress of both the individual and the organization. There is progress on the laws being implemented for the protection of these individuals. Unfortunately, it is not yet enough to cov er all grounds. There is politics where there should not be. There is already injustice to those who are in charge of doing justice. In the end, the people help themselves until they are given full support. Racial discrimination should not exist in the office or the community. It should not exist at all.

Doubt in Macbeth Essay

Doubt in Macbeth The play Macbeth contains doubt in many different ways. In the beginning of the play, we are struck by a very insecure Macbeth. He is indeed curious about what would happen if he were to take Duncan’s place and become the king of Scotland. If it were done when ’tis done, then ’twere well †¨It were done quickly. If th’assassination Could trammel up the consequence, and catch †¨With his surcease success: that but this blow Might be the be-all and the end-all, here, But here upon this bank and shoal of time, We’d jump the life to come. But in these cases We still have judgement here, that we but teach Bloody instructions which, being taught, return To plague th’inventor. This even-handed justice Commends th’ingredience of our poisoned chalice To our own lips. He’s here in double trust: First, as I am his kinsman and his subject, Strong both against the deed; then, as his host, Who should against his murderer shut the door, Not bear the knife myself. Besides, this Duncan Hath borne his faculties so meek, hath been So clear in his great office, that his virtues Will plead like angels, trumpet-tongued against The deep damnation of his taking-off, And pity, like a naked new-born babe, Striding the blast, or heaven’s cherubin, horsed Upon the sightless couriers of the air, Shall blow the horrid deed in every eye That tears shall drown the wind. I have no spur To prick the sides of my intent, but only Vaulting ambition which o’erleaps itself And falls on th’other. (1.7.1-28) We find Macbeth really struggling whether to kill Duncan is the right thing to do or not. He does feel that murdering a man is a great sin, and the fact that this man, Duncan, is someone who trusts him, and also someone that Macbeth himself has showed loyalty to, makes it even worse. /I am his kinsman and his subject/ (1.7.14). Even though this is the case, Macbeth is not completely reluctant towards the idea of killing Duncan. I find that what really haunts him is that it’s more than just the act of murdering Duncan; it is the aftermath that bothers him. What he really is afraid of is that him doing a bad deed, will do come back to him in the end. The thought of becoming king is however tempting, but he is insecure about whether or not this ambition of his is enough to justify the murderer of another human being. This shows very much self-doubt, and in this particular quote Macbeth is really dealing with some ethical problems. On his one shoulder, is the angel telling him tha t it is not the right thing to do, but there’s also the devil who feels that perhaps it could work out. Although, he the angel takes over and he decides that his motives are not enough to kill Duncan. Something that is very interesting is how fast he changes his mind about this. As soon as he announces his decision to the one that I find is the one who is really willing to do anything in order to become the Queen of Scotland, his wife Lady Macbeth that is. Her doubt lies more in the ambitions and morals of her husband, because they are /are too full of the milk of human kindness/ To catch the nearest way/ (1.5.13). It is as if she feels that she is more of a man than her husband is. When Macbeth tells her he will not be murdering Duncan, knows him well enough to know which buttons to push in order to get what she wants. She questions his manhood immediately, and even though he at first stands up for himself by saying /I dare do all that may become a man:/Who dares do more is none/ (1.7.50-51). Lady Macbeth does not experience the antagonist, protagonist discussion in her head that Macbeth does. Her ambitions and morals are a lot clearer, and her single-mindedness ends up being wha t really convinces Macbeth that murdering Duncan is what he must do. This makes Macbeth characteristic of being incredibly full of self-doubt even more obvious. He is easily persuaded by his wife, into doing something that he deep down knows will end up leaving him with feelings of guilt and anxiety. M: One cried ‘God bless us’ and ‘Amen’ the other, As they had seen me with these hangman’s hands. List’ning their fear. I could not say ‘Amen’, When they did say ‘God bless us’ Lady M: Consider it not so deeply. M: But wherefore could not I pronounce ‘Amen’? I had most need of blessing, and ‘Amen’ in my throat. (2.2.32-39) Macbeth has murdered Duncan. Before killing him, he expressed a worry of this giving him bad karma. In this particular quote, I find that his worry has almost developed into paranoia. It is almost as if he starts to question his belief, and whether or not he can rely on God for guidance, the way he may have done before. He realizes most certainly that this deed will be on his conscience for the rest of his life, and I think that wishes he had not done it. His wife on the other hand still shows no signs of doubt, regret or any other feelings one may expect to feel after a murderer. However, I feel that she must doubt the action too. If she had been completely convinced that it was what they had to do, she could have done it herself. In Scene 5 of Act 2, she claims she cannot commit murderer because she is a woman. The era in which this play takes place is definitely different in many ways from the way we live today, but I believe that would not have been impossible for Lady Macbeth to murderer Duncan herself. I believe that it is an ethical dilemma for her as well, she wants to be Queen, but she doesn’t want a murderer on her conscience. Therefore she decides that she can persuade her husband to do it. Out, damned spot! Out, I say!- One: Two: why then, ‘tis time to do’t.- Hell is murky.- Fie, my lord, fie, a soldier, and afeard? What need we fear who knows it, when none can call our power to account? Yet who would have thought the old man to have so much blood in him? (5.1.36-41) Lady Macbeth’s doubt and regrets regarding the murderer really become obvious. She’s sleepwalking, and she is filled with guilt and doubt in whether or not she will actually be able to let go of the crime committed. Earlier on, as mentioned, she was the one convincing Macbeth that the blood, or the guilt that is, would go away /with a little water/ (2.2.65). Now she is not so sure anymore, saying /Here’s the smell of blood still. All the/ Perfumes of Arabia will not sweeten this little hand/ (5.1.51-52). She feels doubt that she will ever be able to live her life as she did before, even though she is now the queen. Is a title really enough to protect her and her husband from what they have done? She is starting to realize that they have created a hell of their own, filled with regret, doubts, sleepless nights that will never end. I feel a lot of desperation in this part of the play, as the consequences of her actions is catching up to her, and her soul is eaten b y doubt. Doubt really is one of the great themes of Macbeth. Throughout the novel one finds both small and large elements of doubt. Besides from the quotes and parts that I have chosen to analyze, there are a lot more to find. There is a doubt going around about who committed the murderer, and if there is such cruelty and hunger for power as it seems Macbeth has. What it all comes back to, is his self-doubt and that I really believe is a message from Shakespeare. One must trust their instinct, or a lot of things could go terribly wrong.
